Only 1.8% of men working at companies in Tokyo took childcare leave within 1 year of their wives giving birth in 2010 despite the fact that 52.5% of them wanted to do so.

東京都内の会社員の男性のうち、２０１０年に、妻の出産後１年以内に育児休暇を取得した人の割合は、わずか１．８％に過ぎなかったそうです。彼らの５２．５％は育児休暇をとることを希望していたそうです。

94.2% of female workers having babies had taken childcare leave in the same period.

ちなみに、同じ時期、出産した女性会社員の９４．２％が育児休暇を取得しました。

An official in charge of the survey said,
"Whether to take childcare leave depends on individual workers' private conditions like income. But if men take part in childrearing, there will be more women who can give birth to second babies. Companies' cooperation is needed to halt the declining birthrate."
I think so too.

調査にかかわったある担当者は次のように述べたそうです。
「育児休暇を取るかどうかは、収入など、個々の労働者の私的な条件に依存します。しかし、男性が育児に参加するようになれば、より多くの女性が第二子を出産できるようになるでしょう。出生率の低下を止めるには、会社の協力が必要です。」
わたしもそう思います。

クラヴィスからプロミスへの契約切替事案の控訴審

昨日、わたしが司法書士として関与しています、クラヴィスからプロミスに契約切替が行われたケースにおけるプロミスの過払い金返還債務の範囲が争点となっている裁判の、控訴審の第一回口頭弁論期日が東京高等裁判所で開かれました。たまたま東京に行ったついでに、裁判を傍聴してきましたので、その様子をレポートします。

ちなみに第一審の長野地方裁判所松本支部は、クラヴィス時代に発生した過払い金を含むすべての過払い金の返還を、プロミスに命じていました。
これに対して、プロミス側が控訴を申し立てたものです。

昨日の第一回口頭弁論期日では、まず、控訴人プロミスの代理人弁護士による控訴状および控訴理由書の陳述が行われました。
続いて、被控訴人（私の依頼者）は不出頭であり、事前提出してありました答弁書の擬制陳述が行われました。
弁論の更新が行われた後、裁判官が、当事者（つまり控訴人の弁護士）に対し、「他に主張、立証はとくにありませんね」と尋ね、控訴人の弁護士が、「ありません」と答えました。
裁判官が、「では、弁論を終結します。判決の言い渡しは○月○日○時とします。」

以上、５分もかからずに裁判は終了しました。
判決の言い渡しは５月下旬になります。

昨日はわたしが関与している事件以外にも、同様の事案と思われる事件の控訴審の第一回口頭弁論期日が同じ法廷で開かれており、プロミス側は別の弁護士が代理人として出頭していましたが、被控訴人が出頭していた点以外は、上記とほとんど同じやりとりで、弁論が終結されていました。

さらに、同じ法廷で、同様の事案と思われる別事件について、「（プロミスによる）本件控訴を棄却する」旨の判決が言い渡されていました。

Some collge students spend spring break helping out in disaster-affected areas.

春休みを利用して被災地の支援に力を注いだ大学生たちがいます。

They rolled up their sleeves and prepared a field for crops carrying soil into a vacant area and removing pebbles.

彼らは腕まくりをして、空き地に土を運び、砂利を取り除き、畑の準備作業をしました。

They also erected mesh fencing to prevent against damage by deer.

彼らはまた、鹿による被害を防ぐための防護ネットを設置しました。

They were responding to the wish of a disaster survivor who is living at a temporary housing complex.

彼らは、仮設住宅に暮らす、ある被災者の願いをかなえようと奮闘していました。

The survivor had spoken of a dream to have the chance to work once again on a field.

その被災者は、チャンスがあればもう一度畑で仕事がしたいという夢を語っていました。

They were sometimes helped by local residents.

彼らは時に、地元の住民らに助けられました。

For example, when residents saw the students' clumsy hammer work, they stopped to give the students a few tips.

たとえば、学生たちの不器用なハンマー作業を見た住民たちが、立ち止まり、彼らに少しのチップを渡す、ということもありました。

A resident said, "They've come from far away and have been working so hard to help us. They are impressive young people."

ある住民は言いました。　「彼らは遠方から来て、一生懸命に私たちを助けるために働いてくれている。見事な若者たちです。」

A student said, "I have plenty of time and physical energy, so I wanted to help, even if it's only a small contribution."

ある学生は言いました。「私にはたくさんの時間と、体力があります。　だから、たとえほんの小さな貢献しかできなくても、私はお手伝いがしたかったんです。」

Another student said, "I'd been thinking for a very long time that I should come here."

別の学生は言いました。「私はとても長い間、ここに来るべきだと考えていました。」

He also said, "A lot of manpower is still needed here. I'd like to continue to be involved in activities."

彼はまた言いました。「ここでは、まだたくさんの人手が必要とされています。私は支援活動に関わり続けていきたいです。」

Between April 2011 and February 2012, some 5000 college students visited the affected areas with the Nippon Foundation group as volunteers.

Yumi Matsumoto, deputy leader of the nonprofit organazation "Iwate Ginga-Net" which serves as a bridge between students and residents, said,

"We want student volunteers who are able to work together with disaster survivors to come here."

new technology to prevent Furikome Sagi

A Japanese company and an university have developed technology to automatically detect telephone billing fraud by using voice analysis.

日本の会社と大学が、声の分析により振り込め詐欺を自動的に検出する技術を開発した。

They will start testing the technology with police and bank later this month.

彼らは警察と銀行と共同で、今月下旬からその技術のテストを開始する予定だ。

The technology combins with detection of such keywords as "compensation" and "indebtedness".

By that, unusual conversations including those typically heard in "furikomesagi" remittance frauds are identified with over 90 % accuracy.

それにより、「振り込め詐欺」に典型的に含まれる異常な会話が９０％の精度で識別される。

It's unique. If it can contribute to prevent "furikomesagi", I want to welcome it.

Japanese government approved a bill to make it easier for lawyers with foreign qualifications to set up their offices in smaller cities in Japan.

日本の政府は、外国での資格をを持つ弁護士が日本の小さな都市にも事務所を開設しやすくする法案を可決しました。

It is expected to improve convenience for lacal companies seeking to expand business abroad.

これにより、海外での事業展開を目指す地方の企業にとっての利便性の向上が期待されています。

It means that they will be able to receive counseling from foreign lawyers,

すなわち、彼らは外国人弁護士によるカウンセリングを受けることができるようになります。

Under the current law, lawyers with foreign qualification are allowed to open only one office through a cooperative system.

現行法では、外国での資格を持つ弁護士は、協調制度により、一つの事務所の開設のみが許されています。

Because of it, they have tended to work mainly in large cities.

そのため、彼らは主として大都市に集中する傾向にありました。

The planned law revision will give corporate status to their organizations, opening the way for them to set up several offices in Japan.

An Ainus mans story (1) あるアイヌの男の話 (1)

I was moved when I read an article about a man, the other day. I will introduce the aricle here.

先日、私は１人の男性に関する記事を読んで感動しました。　ここにそれを紹介します。

The man's name is Shiro Kayano, 53 year old. He is a leader of the recently formed Ainu Party of Japan.

男性の名前は「Ｓｈｉｒｏ　Ｋａｙａｎｏ」、５３歳です。　彼は最近結成された日本アイヌ党の党首です。

He was not raised in an especially strong Ainu cultural environment, nor did he involved in any Ainu rights movements until his late 20s.

彼は、特別に強いアイヌ文化の環境下に育ったわけではなく、２０歳代後半まで、アイヌの権利運動に関与することもありませんでした。

His father was the first of the people to ever serve as a member of the House of Councillors.

彼の父親は、アイヌ出身では初めての参議院議員でした。

But, as a child, he never spoke his indigenous language at home with his family.

しかし、彼は子供のころ、家でアイヌ語を話すことはありませんでした。

He went to Canada with his father to study the Kwakwaka'wakw, a First Nation's people in British Columbia in 1987.

１９８７年に、彼は、ブリティッシュ·コロンビア州のファーストネーションの民族である「Kwakwaka'wakw」の研究のため、父親とともにカナダヘ渡りました。

The trip completely changed his ambitions and the course of his life.

Kwakwaka'wakw means "those who speak Kwak'wala". But the people under the age of 70 spoke nothing but English.

However, Kayano saw the dedication with which the elderly taught the young their native language. He was 29 then.

しかし、Kayanoさんは、年配の人たちが若者に自分たちの母国語を教えようとする献身的な姿を見ました。　このとき彼は２９才でした。

He was suddenly struck by the notion that his own people were facing the same crisis.

突然、彼は、彼ら自身すなわちアイヌ民族も、同じ危機に直面しているという概念に打たれたのです。

American woman won in a small-claims action アメリカ人女性が少額訴訟で勝訴

An American woman who filed a small-claims action against Honda won her lawsuit.

ホンダに対し、少額訴訟を提起したアメリカ人の女性が勝訴しました。

Judge ruled that the automaker misled her about the potential fuel economy of her hybrid car.

裁判官は、ハイブリッド自動車の燃費について、ホンダが女性を誤解させたと判断しました。

The court awarded her $9867. It is much more than the couple hundred dollars cash that a proposed class-action settlement is offering.

裁判所は、女性に対する9867ドルの支払いを認めました。　この金額は、クラスアクションにおいて提示された和解金より数百ドル高額なものです。

Legal fee in the class action would give trial lawyers $8.5 million, she said. In small claims court, there are no attorneys' fees.

Japan reached settlement with the relative of atomic bomb survivor who lacked certificate 国が証明書のない被爆者の親族と和解

The gov't agreed with survivors and relatives of victims of 1945 atomic bombings who are living abroad to pay 1.1 million yen each to settle a damages suit filed over their failure to receive state support.

政府は、海外に暮らす1945年の原爆による被爆者と犠牲者の親族が国の援助を受けられなかったことにより、彼らが提起した損害賠償請求訴訟の解決のため、彼らそれぞれに対し110万円を支払うことで、合意しました。

A relative from Brazil represented a woman who didn't possess an atomic bomb survivor's handbook.

ブラジル出身の一人の親族が、原爆被爆者手帳を所持していなかった一人の女性の代理を務めました。

It is the first time for the state to reach a settlement with the relative of survivor who lacked official certification.

国が公的な証明書を持たない被爆者の親族との間で和解に達したのは初めてのことです。

The woman, who died after moving to Brazil, was recognized as a survivor based only on a disaster victim certificate she receive in 1945.

ブラジルに渡った後に死亡したその女性は、1945年に受け取った罹災証明のみに基づいて、被爆者と認定されました。

53 plaintiffs including 51 survivors living in South Korea and 2 in Brazil filed the suit in May 2011.

韓国に暮らす51名と、ブラジルに暮らす2名の計53名が原告となり、2011年5月にその訴訟を起こしました。

They insisted they suffered emotional distress after being left without benefits and public assistance under the Atomic Bomb Survivors Support Law because they reside outside of Japan.

彼らは、海外在住を理由に原爆被爆者支援法に基づく手当と公的援助を受けられずに放置されたことにより、精神的苦痛を受けたと主張しました。

Foreign candidates for care workers took the examination to gain the Japanese gov't certified license for the first time alongside Japanese.

介護福祉士の外国人の候補者が、初めて、日本人といっしょに、国家資格をとるための試験に挑戦しました。

Obtaining the license requires having experience working as a care worker for 3 years or more in Japan, in addition to passing the exam.

国家資格を取得するには、試験に合格することに加えて、日本で3年以上、介護福祉士としての仕事に従事した経験か必要とされます。

Since foreign candidates are allowed to stay in Japan only 4 years to qualify to take the exam, the 4th year of stay provides the only oppotunity to take it.

外国人の候補者は、受験資格を得るため、4年に限り、日本に滞在することが許されています。それゆえ、滞在の四年目が、試験を受ける唯一の機会ということになります。

Once a candidate passes it, he or she is allowed to renew stay permits indefinitely.

試験に合格さえすれば、彼または彼女は滞在許可を無期限に更新することが許されます。

As an exceptional measure, the gov't will extend the stay permits of foreign candidates by one year if they score certain marks in the exam, so they can take it again next year.

例外的な措置として、政府は、試験で一定の点数をとった外国人候補者に対し、1年まで、滞在許可を延長することになっています。　これにより、彼らは翌年に再度受験することができます。

It is difficult challenge for them to pass the exam because they must overcome the problem of language.

彼らにとって、試験に合格することは至難の業です。　なぜなら、彼らは言葉の問題を克服しなければならないからです。
